The Central government of India, has filed a petition against the AAP government in Delhi regarding the powers issue on the Union Territory of Delhi.
Earlier, the Delhi government has approached the Delhi high court against the Home Ministry’s notification stating that the state government has no right to appoint officials or to punish the police, who are under the Central government of India, since Delhi is a Union Territory.Before that Delhi CM Kejrival had a tough war with Lt. Governor Jung over the issue of appointing officers.
Delhi High court earlier ruled that, the State government has the right to punish the police officials by the state held Anti-Corruption unit, The Times of India reports.
Supreme Court on the other hand, refused to stay the orders issued by the high court earlier. It stated that the orders passed by the high court was in due reference to the notification and that it was not binding.
It has further added. that the High court cannot decide over the power tussles between the state and the central governments.”The power to solve such issues between the state and the centre lies only with the supreme court”, the court said. However, it summoned the Delhi government to decide whether he wants the hearing to be continued at the Supreme court or the High court of Delhi.
